Police release complaint against Jones and Smith

University of Wisconsin football running back Dwayne Smith raped a 19-year old victim while another man, Anwar Jones, watched, according to a criminal complaint filed Wednesday.

The complaint says Smith, 19, raped the victim after Jones, 22, brought the woman back to an apartment at 630 N. Frances St. early Sunday. Both were arrested Sunday night and charged with second-degree sexual assault, which could be penalized with a maximum 40-year prison sentence.

According to Lt. Sue Williams, lead investigator of the case, the woman said she had been to a party hosted by UW football players when Jones took her back to the apartment of his cousin, UW wide receiver, Trevann Hayes.

According to the police complaint, the woman and Jones were kissing in a bedroom in the apartment when Smith entered the room and said, “this is going to be the best night of your life.”

Smith then pushed the victim down on the bed while Jones stood by the door and turned off the lights. Smith undressed the woman, pushed her into a corner of a bed against the wall and raped her.

The woman repeatedly told Smith “no” but Smith said, “Let me finish,” while Jones told her, “Let him do it.”

“It felt like he was ripping my insides out,” the woman told police.

Williams said the victim was treated and released from a Madison hospital Sunday.

Smith said he was at the apartment when the woman was there, but initially told Detective Marion Morgan he went to the bedroom to get his coat, and only saw her naked in the bed with Jones.

He later admitted to touching the woman, whose name he said he did not know, and finally told the police he asked Jones for a condom which Jones got for him.

Charles Giesen, Smith’s lawyer said Wednesday his client would appeal his suspension of the football team and said Smith “denies guilt of anything.”

Giesen was unavailable for comment Thursday.

Smith was released from jail on signature bond Monday. Jones remained in jail until Wednesday afternoon when his friends bailed him out and his bail was lowered from $2,000 to $1,000.

Jones, who is from Elgin, Ill., is reportedly currently residing with his cousin, Hayes, at the apartment on N. Frances St.

Smith, a sophomore, is the leading rusher for the Badgers. He rushed for nine touchdowns and averaged 65.9 yards a game last season. Smith was valedictorian at his high school in Chicago, an academic all-state honoree and a member of the National Honor Society.
