Woman Tasered at Badger game settles lawsuit

After being Tasered by two University of Wisconsin Police Department officers last year at Penn State, Margaret Hiebing, 54, has settled her lawsuit against the department for the sum of $50,000.

Hiebing claimed in the suit that officers Tamara Kowalski and Peter Grimyser wrongfully used excessive force when she was unable to sit in her proper seat.

She claimed Kowalski pulled her hair and threatened the use of pepper spray, which initiated a series of events, culminating in Grimyser Tasering and arresting the Madison resident, according to a statement obtained by The Badger Herald.

“[UWPD] contended that they did not do anything outside the boundaries of the law and we disagreed with that,” said Bob Gingras, head attorney for Hiebing.

Supported by multiple witnesses, some of whom were very prominent citizens in the community according to Gingras, Hiebing was very satisfied with the settlement after a full day of mediation with former Circuit Court Judge Angela Bartell presiding.

Gingras said the settlement was mutual: Both sides wanted to resolve the case and acted cooperatively to do so.

“[Hiebing] was never in the lawsuit for money, which seems like the only thing you can get out of our legal system,” Gingras said.

Hiebing wanted to send a message to the police about how to treat law-abiding citizens, according to the statement.

“Margaret hopes that this settlement will get the authorities to reexamine how the police interact with fans at the game when a fan cannot get into his or her seat,” Gingras said in the statement.

While Gingras said he thinks there should be more opportunities to actually change systems than what is presently available, Hiebing was happy with the settlement and thought it would have an impact on the department in the future.

All charges for disorderly conduct and resisting arrest filed against Hiebing were dropped long before the settlement, according to the statement.

UWPD has issued no formal apology; however, Hiebing did not request one, according to Paul Kinne, assisting attorney for Hiebing.

UWPD declined to comment.
