Library mall piccolo player Thomas J. Ryan said he was issued a second noise violation ticket on Sept. 25, although he said he was acting in accordance with recommendations for playing outlined in the judge’s ruling on the previous ticket.
According to Ryan, Madison Police Officer Mike Edler ticketed Ryan in front of the University Book Store, the same location as the previous ticket, at 2 p.m. last Friday without warning Ryan or asking him to stop or move along.
In the ruling from the first ticket, Ryan is allowed to continue to play his music in the State Street area but should shorten the performance to less than three hours a day in the same area and should alternate the blocks he plays on every day, Ryan said in an e-mail.
Ryan also said he had kept his performances to less than three hours and rotated them between the 700 and 800 blocks of State Street.
