Madison Police Department arrested a man early Friday morning, Sept. 18, for homophobically aggravated battery.
According to a MPD incident report, the incident occurred on the 200 block of State Street around 3 a.m. when 35-year-old Courtney Spinks attacked the 23-year-old victim, who identifies as transgender.
Joel DeSpain, MPD spokesperson, said the victim was punched in the face and was later admitted to the hospital for stitches and a facial fracture.
The victim hailed a cab to alert the driver of the situation; the driver then called the police. He said the police are treating the battery as a hate crime.
According to the report, the victim said the suspect used derogatory and homophobic names.
DeSpain said police caught the suspect in the nearby area after being called to the scene.
According the report, the two parties involved were acquaintances.
Incidents deemed as hate crimes carry more punitive sentencing in Wisconsin, according to the state statute.
