For the first time, tuition this fall is being offered and accepted by undocumented residents within the University of Wisconsin System after Wisconsin Gov. Jim Doyle signed into effect a change of law that allows undocumented residents to receive in-state tuition, making Wisconsin one of 11 states that support this.
The other 10 states that give illegal immigrants in-state tuition are California, Illinois, Kansas, Nebraska, New Mexico, New York, Oklahoma, Texas, Utah and Washington.
Currently, the federal government has the right to punish states that provide in-state tuition to undocumented students by obligating those states to provide the same benefits as undocumented students to those who don’t live in the state, according to the terms of the Immigration Reform and Immigrant Responsibility Act of 1996.
However, the Development Relief and Education for Alien Minors Act, or DREAM Act is currently before Congress, which would revoke that section of the law.
To receive the tuition, the students must first have lived in the state of Wisconsin for at least three years and graduated from a Wisconsin high school. The students must then sign a legal affidavit indicating they will seek residency in the near future, according to a statement.
“These are young students looking for opportunities to advance in their education, and it’s important for us to give them that opportunity, and in-state tuition helps this,” UW Board of Regents President Charles Pruitt said.
Because undocumented residents are unlikely to receive any financial aid when applying to UW schools, this new law greatly decreases the cost of attending college for the students. In-state tuition decreases the cost for students by more than half, which lowers the price at UW-Madison from $21,800 to $7,500 per year.
With 35 applicants, UW-Milwaukee had the most students applying for resident tuition this fall. The next closest was UW-Oshkosh with four, then UW-Madison with two students, and UW-Whitewater and UW-Stevens Point both had one.
Students who pay in-state tuition are effectively subsidized by the state. Therefore, while Wisconsin workers are in effect paying in part for the education of these undocumented residents through taxes, UW System spokesperson David Giroux does not see this extra cost to the state and workers as a cause of concern.
With a college degree, the long run hope is these students will be able to receive high paying jobs when entering the workforce, Giroux said.
He added higher paying jobs not only benefit the students themselves, but also the state as it receives more tax revenue off higher incomes.
“People who earn more pay more taxes and those revenues support universities and health care,” Giroux said. “To get more college degrees in our workforce and provide folks with educational opportunities is in our best interest when you consider the alternative.”
Because the number of undocumented students remains very small and in the single digit range for most schools, Giroux does not believe the loss of out of state tuition from these students will greatly affect the school. Pruitt agrees, saying passing this law only increases the number of students attending UW schools and does not displace anyone.

Do you think I received financial aid? Loans? NO…Ive had to work my butt off to be where I am. I don’t go blaming other people for not being able to achieve my goals. I JUST ACHIEVE THEM. Go cry somewhere else. No one feels sorry for people that live in the best country in the world, with the best opportunities available to them. You can get loans, financial aid, grants and scholarships. Astonishing Doublespeak and ignorance by UW System spokesperson David Giroux — or perhaps a deliberate fraud… How? In true Orwelling fashion Giroux asserts:

This is an outright lie.
Fact 1: Illegal immigrants are Never authorized to work.
Fact 2: If an illegal immigrant does work without authorization, one of the following MUST occur: either (A) the illegal alien must present his employer with false documents which fraudulently establish his the right to work - and those documents must suceed in deceiving his employer into believing he not an illegal immigrant and is authorized to work, or (B) the employer must violate the law requiring employers to verify that all employees are authorized to work and be present in the United States.
Fact 3: In the case of (A) above, the illegal alien has committed the felony crimes of submission of false documentation to obtain a federal benefit (the right to work in the US), as well as possibly numerous other crimes depending on the source of the false documents (such as identity theft if the documentation is valid but belongs to another, legal resident) or forgery and falsification of official documents (if the documentation presented is forged).
There is no way around it. If a graduate from UW is an illegal immigrant, by law he CANNOT begin work at a “higher paying job” or any other job in the US, without committing one or more crimes — and not minor crimes but serious federal felonies.
Bottom Line: Mr. Giroux is encouraging felonious behaviour by talking about his illegal alien graduates working in the US after graduation.

Chill out crazy Mexican haters, and think about putting yourself in the situation illegal college students are in. Your parents brought you here illegally to try to make a better life for you, and it wasn’t your choice. You want to get a good job after high school, which is difficult to do without a degree. So you go to college. Since your folks are probably barely scraping by with their service sector jobs/welfare, how would you pay for school? You obviously speak perfect English, got good grades, and graduated from high school if you were even accepted into a university in the first place.

I appreciate this opportunity. I was undocumented most of my life. I wasn’t even aware of it; I was only 7 when we escaped the violence from my native country. I didn’t find out about my status until I started applying to college and after I was named Valedictorian of my high school.
I struggled a lot, but I found a path to legal residence. Many of my peers who are in that situation are not that lucky. They are waiting for the opportunity to be productive American citizens. It is not because they want to take advantage of this ‘new’ country; it’s their home. They grew up here, just like I did. It wouldn’t make any sense.

There’s violence on the streets every day. Schools are shut down, people are losing their jobs, and you’re struggling to feed your kids. No. You’re going to do what’s best for your children, and that’s getting them out of there and into safety. An illegal should not even be in the country, that’s why! Think about the money being spent on them. That money could be used to pay tuition for an American student who IS a US citizen.
Here’s another thought: Mexico pays about $24 billion a year in federal fuel subsidies so they can fill up their SUVs for cheap. Mexico also offers free Viagra for men over 70. Free Viagra? For men over 70, who should be preparing to meet their Maker instead of getting laid? And the most obscene thing of it is that Mexican taxpayers are paying for it! But no, liberals like you want all natural-born US citizens to suffer so that illegals can sneak into the US and take away our jobs and education opportunities.
Look, if you really want to help poor Mexicans, start a movement to put serious political pressure on Mexican president Calderon to fix Mexico. He wanted so bad to be president and now he is, though he was elected under questionable circumstances. Every Mexican president for the last 70 years has done nothing to fix their economy. The big businesses of our country haven’t left many manufacturing jobs for anyone… illegal or US citizen. You can thank them for sending away a large chunk of American jobs.

The majority of these comments are an embarrassment to this state. Many illegal immigrants do work and actually end up getting taken advantage of by their employer due to their status - so they are not just a drain on society. I think it’s wonderul that States are finally starting to realize that immigrants are perfectly capable of contributing great things to this nation. I would also like to point out that even though some immigrants do use some of the resources available in this country, their contributions offset those costs. The next time you’re eating apple, think about who picked it for you. The probability that it was an immigrant is extremely high. Also think about how much you paid for that apple. Very few people be willing to do such back-breaking work for so low of a wage. It’s thanks to those immigrants that you didn’t have to pay 10 times as much for that apple.

The land was CONQUERED by our ancestors - there was no sneaking across the border involved. The earlier immigrants (they were no more “native” than the Europeans) were CONQUERED by those who came later, they lost - just like other people lost their lands throughout history. If liberals would concentrate on the “genocidal drug war” south of the border instead of the imaginary genocidal war in Israel. I don’t care what’s going on halfway around the world, I care about what’s happening here at home. And if you liberals care so much about all these illegals, why don’t you get on Calderon’s ass and tell him to straighten out his country. I’m sick and tired of seeing the US turned into a dumping ground for Mexico’s criminals and rejects. We have Americans who are begging for jobs. We also have illegals doing jobs that pay $12-$18/hour. And they claim they do the jobs Americans refuse to do. Yeah, right! Try and find an American who’d turn down a job like that. How many illegals got hired at that new Hy-Vee out on East Washington? How many illegals are working on construction sites and road crews across Wisconsin? That’s how many Americans are homeless because employers prefer foreigners who will work a dollar and hour cheaper. And that’s not counting the families they have to feed.
So the next time a liberal says illegals are essential to keep the price of apples cheap, ask them what they’ll do when an illegal takes their job and it won’t matter how apples cost since they don’t have a job.

The federal statute, correctly cited on this blog by Watchdog, refers to benefits based on residence. As pointed out in your article part of the criteria is not simply residence but that the person “graduated from a Wisconsin high school.” Similar language appears in the statutes of other states and the issue of whether this distinction prevents the legislation from running afoul of the federal statue is being litigate in the courts. Until there is a final determination by the courts your categorical implication above is simply an opinion.
Back in the 1970s we thought that freeing newspapers from the yoke of the university would enhance journalistic integrity. In the ensuing years it appears that journalistic integrity has become an oxymoron.

If your getting out of state tutition, it’s cause you haven’t lived in the state long enough. Undocumentizing your self wouldn’t change that. I’m proud to be from a state (California) that offers in-state tuition to undocumented immigrants. Unfortunately, because the state legislature, and particularly the governor, isn’t willing to tax corporations and the richest people in the state, budget shortfalls are huge and education and many other public services are falling apart. Working people of all races and nationalities need to join forces to stop letting the state get away with this. NAFTA and CAFTA sucked jobs out of the country, and devastated Latin America, driving immigrants here. Citizens and immigrants have both been victimized by these schemes.

Why have I not read the terms “illegal drivers”? “Illegal drinkers”? “Illegal partying students”?
Why can you break almost any law in this country (including torturing people) and not even be called an illegal, let alone persecuted? But if your skin is brown, or your last name ends in “-ez” (remember, to be white the census still demands that you be non-hispanic) you are called illegal for much less.
A man can be convicted five times of murderously driving intoxicated and be called, the Honorable Representative so and so. My best friends, my cousins, my uncles, are called illegals. They have never hurt anyone. They have never tortured anyone. They did not make the economy of this country collapse. They did not steal millions. They do not murderously deny global warming. They do not hire death squads to murder union leaders in Colombia. They pay all their taxes, and will never receive a dime in social security payments. They prepare your food, clean your hotels, fix your house, your car, harvest almost everything you eat.
So let’s be honest here. You are calling them illegals not because they broke a law, but because they are brown.

To the Idiot paying 22 grand a year to go to that particular university. Had you stayed in your state, you wouldn’t be paying out of state tuition, plain and simple. The DREAM Act requires that you attend high school in the same state that you want to attend college in order to receive instate tuition. In reality they aren’t receiving so called benefits over legal residents, they are just receiving what you guys do. So stop crying about paying out of state tuition. No one put a gun to your head and told you to leave your state…

It’s sad that this limited supply of aid is not used to help improve and educate Americans—especially during these hard times.
