Police arrested singer Howard Day on charges of disorderly conduct, criminal damage to property and intimidation of a victim after a concert early Thursday morning.
<p>Day, who played with the Howie Day Band as the opening act for the Barenaked Ladies Wednesday night at the Alliant Energy Center, was jailed and then released on $850 bail early Thursday morning.
<p>Sgt. Wayne Stolpa of the Town of Madison Police Department said police responded to a 911 call made at the location of Day’s tour bus.
<p>Stolpa said several women were invited on the band’s bus after the show, and after some period of time, one of them wished to leave.
<p>”One female left and invited another female to leave with her,” Stolpa said, adding Day did not want the departing woman’s friend, who was in the bathroom in the tour bus at the time, to leave.
<p>After this exchange, Day “ordered the [departing female] to leave the bus” and held the bathroom door shut so the other woman could not leave the room, according to Stolpa. At this time, the female leaving the bus threatened to call the police on her cell phone.
<p>”The victim had her telephone taken from her [by Day] and had it broken,” Stolpa said.
<p>The disorderly-conduct charge stems from Day allegedly blocking the bathroom door, and Stolpa said the charge of intimidation of a victim is a result of Day threatening the victim if she called the authorities.
<p>All the charges are misdemeanors, and carry a maximum fine up to $10,000 or nine months in jail.
<p>Ted Ballweg, director of sales and marketing at the Alliant Energy Center, noted the incident did not occur in the building.
<p>”From a building standpoint, nothing went wrong,” Ballweg said, adding there were “no issues during the show.”
<p>”It was a good show,” he said.
<p>Day’s manager, Shawn Radley, said Day did nothing wrong, and Day’s attorney agreed.
<p>”Everyone’s blowing this way out of proportion,” Radley said.
<p>Day, whose first court date is Monday at 10 a.m., has already left the state and does not need to appear in person.
<p>Day has achieved recent success, especially in the college crowd, with his 2003 release <i>Stop all the World Now</i> and his appearance on the “I Am Sam” soundtrack.
